Terms and Conditions
('You', "the Renter" means the person who has loaned the Product from COMPANY and signed on the Rental Agreement; COMPANY shall mean Sony Electronics (Singapore) Pte. Ltd.)
1. Rental Fees. Renter agrees to pay the Rental Fees for the responding lens (“Product”) to the COMPANY in the manner as set forth in the Annex A attached hereto. Unless otherwise agreed, payment shall be due upon collection of the Product at Sony Store, 313@Somerset.
2. Renter Eligibility and Collections. Only Singapore citizens, Singapore Permanent Residents and residents holding work permit with at least 6 months validity remaining, who are above 18 years of age is eligible. Only 'My Sony' members, existing purchasers of Alpha products who have registered their warranty with COMPANY are applicable to be the Renter. Unless otherwise further informed by COMPANY, no prior reservation for the Product is accepted. Each Renter is strictly allowed to borrow one (1) piece of each lens only. Each Renter shall not rent the same Product within the same month, and there shall be at least 5 days apart. The Lens rental transaction (both pick-up and return) will be done physically via Sony Store, 313@Somerset and is based on first-come-first-serve basis. Verification is required at point of rental at 'Len Library' counter at Sony Store, 313@Somerset. Renter has to present a valid photo ID (such as passport, driving license or photo ID card) upon collection of the Product. If COMPANY has reasonable doubts about the authenticity of the ID of the Renter, the Rental validity may be declined and full charge may be levied. COMPANY may take a copy of the ID.
3. Responsibility for Product, Indemnity and Assumption of Risk. Upon acceptance by Renter of the Product on a will-call basis, Renter agrees to inspect the Product at the time of acceptance. All defects or malfunctions must be reported to COMPANY within that time. Renter shall hold COMPANY harmless and indemnify COMPANY from all claims, liabilities, damages, costs or losses arising from or related to injury or damage to the Product or to persons or property arising from or related to the use, maintenance, storage or transport of the Product during the period of Renter's responsibility. Renter shall indemnify and hold COMPANY harmless from any claims, liabilities, damages, costs or losses arising from claims against the Product asserted by Renter's creditors. Renter acknowledges there is a risk of losses, injuries or damages arising from or related to the use or transportation of the Product and assumes all risk of such losses, injuries or damages. Renter releases COMPANY from any and all responsibility or liability for such losses, injuries or damages which Renter may experience arising from or related to the failure, use, maintenance, storage or transport of the Product.
4. Returns and No Damages. Renter agrees to return all items in the same condition as received, which shall include the original condition of the Product including, but not limited to, lens hood, front or/and rear lens covers, and original packaging as received. COMPANY's acceptance of the return of the Product is not a waiver by COMPANY of any claims it may have against Renter, including claims for latent damage to the Product. If repairs or replacements are required, Renter agrees to pay all labor, material and shipping charges. COMPANY will collect back the lens, assess and charged accordingly. If beyond repair, then lens will be deemed sold to customer at full SRP. COMPANY may charge Renter Late Penalty Charge as specifically set forth in the Annex A attached hereto. In the event that loan is due but customer or/and lens cannot be located, COMPANY will log-in and hand over case to police end to handle.
5. Title to Goods. The Product is the sole and exclusive property of COMPANY and Renter has no right, title or interest therein, except as set forth in this Rental Agreement. Renter will not alter ownership markings on the Product. Renter will keep the Product free from the claims of third parties.
6. Term of Service. The Rental Period is five (5) days including both pick-up & return day. Each Renter only applies for one (1) Rental Period and strictly no extension is allowed. Pick-up and return of lens is daily (from Monday to Sunday) during Sony Store, 313@Somerset operating hours (11am to 9pm). Collection of the Products by you shall commence on the rental starting date mentioned in the Rental Form.
7. Personal Information. Your personal information will be held and used by COMPANY, and may be shared with COMPANY's service partner acting on its behalf for administration purpose in connection with this Rental Agreement pursuant to the Data Protection Policy (www.sony.com.sg/microsite/privacypolicy). You agree and understand that COMPANY and its authorized service providers may need to access, use, or process your data and provided content in order to perform related services pursuant to this Rental Agreement.
8. Governing Law, Venue. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, and Renter agrees that all disputes shall be resolved in Singapore.
